Conditions of Issue of Report

  1. The following terms have the accompanying meanings:
    1. BMWS means Transtechnology Pty Ltd trading as Bundaberg Metallurgical & Welding Services;
    2. Client means the client named on the face of the Report;
    3. Finding(s) means any conclusions and/or recommendations set out in the Report; and
    4. Report means this report, including any schedules and annexures.
  2. BMWS does not accept any legal liability or responsibility in respect to the use of the Report for any purpose other than its stated purpose.
  3. This Report is provided solely for the use of the Client. The Report should not be used or relied upon by any person or entity other than the Client. BMWS does not accept any legal liability or responsibility in respect to the use of the Report by any other party other than the Client. This report shall not be reproduced except in full.
  4. The Report makes Findings from matters evident at the time of inspection of the article(s) the subject of the Report. The Report will not make Findings from matters:
    1. That are not detectable by means of the instrument(s) and/or testing methodology used to produce the Report;
    2. That come into existence after the time of inspection; and/or
    3. That is only apparent in conditions other than those conditions prevailing at the time of inspection.
  5. Where the Report was prepared on the basis of random or interval test of the article(s) the subject of the Report that will be stated in the Report. Such a Report will only be indicative in nature and any Findings made will relate only to that area of the article in respect of which testing was conducted.
  6. Where the Report was prepared on the basis of a sample provided by the Client, the Report will only make Findings in respect of the sample provided by the Client. BMWS makes no representations in respect of the article from which the sample was collected.
  7. Where the Report includes information supplied by the Client and BMWS cannot confirm the accuracy of this information, this information will be identified in italics. BMWS makes no representations in respect of the accuracy of such information, or Findings based on such information.
  8. BMWS limits its liability by producing this Report to a maximum of the value of the services it has provided for this item of work and will not be liable for any indirect or consequential loss or damages including loss of profits or loss of opportunity.
